U.S. Tax Filing Requirements
In general, If you are a US citizen or resident alien (green card holder), you are required to file an annual U.S. income tax return reporting worldwide income. Even if you work overseas and don't owe any tax, you must file a tax return in order to take the foreign earned income exclusion.

Filing Due Date
If you lived abroad on April 15, then you are automatically granted extension until June 15 to file your taxes. You may file extension to extend your filing due date to October 15. Keep in mind that you may extend your time to file your taxes but you cannot extend your time to pay your taxes. If you owe taxes, then you must pay your taxes on or before April 15 with your extension or make quarterly estimated tax payments.

First Year Expatriate
In order to apply for the foreign earned income exclusion, you have to pass either the Bona Fide Residence Test (living abroad a full calendar year) or Physical Presence Test (330 days in a 12 month period). Your first year exclusion amount will be prorated to the proportion of the year in which you lived abroad. We can help you to apply for a special filing extension to help you to meet those tests.

Exclusion Amount
The Foreign Earned Income Exclusion for 2009 is US$91,400. This amount is adjusted for inflation every year.

Foreign Bank Accounts
If you have foreign bank accounts, i.e. checking, investment brokerage, with balance over US$10,000, you must file "foreign bank account reporting form". The due date is June 30.

Non-U.S. Resident Spouse
If your spouse is a non-U.S. resident, you may choose from three filing status options:

        1. Married filing separately and report your income only,
        2. Head of household and claim your dependents, or
        3. Married filing jointly to report both you and your spouse's income.

Sponsor for Green Card
You will have to provide your tax returns in order to sponsor your spouse and relatives for green card. We can help you to file or amend any prior year income tax returns.
